After defendant's arrest on the gun charge, Mr. Fenster went to the judge on the prior felony and had the felony reduced to a misdemeanor, effective 2006. The district attorney on the new charge was very upset, but who cares...since the prior felony was now reduced to a misdemeanor effective before the new case, the new case was dismissed.

  • A successful Iranian businessman, with an American wife and child, was convicted of three felony charges for credit card forgery in 1995.  He successfully completed probation, but he could not obtain his U.S. citizenship because of the convictions.  He was worried sick about being deported, because his green card was expiring, and could not be renewed.  Mr. Fenster filed a motion to vacate his conviction in its entirety, and despite the vigorous opposition of the district attorney's office all charges were vacated, thus allowing the client to now obtain U.S. citizenship.

  • Client was charged along with many other co-defendants with three counts of Grand Theft and one count of Conspiracy to Commit Grand Theft. The loss was alleged to be in the millions. All the other Defendants pled guilty. After several days of trial, the D.A. agreed to accept $20,000 as restitution and all the counts were dismissed, without any conviction at all.
