The Law Offices of Alan Fenster has also had remarkable results in appeals of criminal convictions. Unmatched Experience and SuccessDuring his years in practice, Alan Fenster has cultivated relationships with prosecutors and judges. When all evidence points to guilt, he works with prosecutors to arrange the best plea agreement possible. However, with over 100 not guilty verdicts in criminal trials (including murder acquittals), he is undaunted in taking a viable case before a jury. A prime example:Alan Fenster recently handled a first degree murder case in which his client was charged with shooting the victim in the back. The victim was running away up a driveway while the defendant pursued, shooting from a vehicle. There was no question that our client fired the fatal shots. At trial, Mr. Fenster demonstrated that the victim and his friends had repeatedly intimidated the defendant through threats and fistfights because of animosity over gang activities. The client testified that he opened fire out of fear of what the victim and his friends might do in the future. Because of the rapport Mr. Fenster developed with the jury, they found his client not guilty of the murder charge. The client was convicted only of manslaughter and received a determinate prison term, versus the life sentence he would likely have received for a murder conviction. Our firm is presently handling another first degree murder case in which a victim was shot in the back while riding away on a bicycle. Alan Fenster is preparing a similar defense that the not-so-innocent victim had been threatening the defendant in the recent past. Mr. Fenster expects to obtain a favorable result in this case as well. Whether you are charged with premeditated or intentional murder, a crime-of-passion killing, or involuntary manslaughter resulting from a fight, assault, or drunk driving incident, you will need a strong defense to avoid the worst outcome.
